Terms and Condition

Welcome to Thousand Oaks Tree Service, a fully licensed, bonded, and insured tree care company proudly serving Thousand Oaks, CA, and surrounding areas. These Terms and Conditions ("Terms") govern all services including tree removal, trimming, pruning, stump grinding, emergency storm response, and landscaping support. By requesting a quote, scheduling service, or allowing our crew on your property, you agree to be legally bound by these Terms.
1. Service Agreement & Scope of Work
- Written Estimates: All quotes are valid for 30 days unless otherwise stated. Estimates are based on visual assessment and may be adjusted if site conditions differ (e.g., hidden utilities, access issues, tree decay).
- Acceptance: Service begins only after signed approval, verbal confirmation, or payment of deposit.
- Additional Work: Any changes or extra services require a new estimate and approval. Verbal requests on-site may incur immediate charges.
2. Pricing and Payment Terms
- Transparent Pricing: Rates include labor, equipment, fuel, insurance, and standard debris removal. Prices are final once agreed upon in writing.
- Payment Schedule:
- Full payment due upon completion unless pre-arranged.
- Accepted: Cash, check, credit/debit cards, Zelle, Venmo, or approved digital payments.
- Deposits (up to 50%) required for jobs over $1,500 or special-order materials.
- Late Fees: Balances over 30 days accrue 1.5% monthly interest. Unpaid invoices may result in a mechanic’s lien on the property.
- Returned Checks: $35 fee applies.
3. Scheduling and Site Access
- Appointment Windows: We provide 2-hour arrival windows. Delays due to weather, traffic, or prior jobs do not constitute breach of contract.
- Property Access: You must ensure clear, safe access to work areas. This includes:
- Moving vehicles, pets, toys, and furniture.
- Unlocking gates and securing animals.
- Notifying us of sprinklers, lighting, or invisible fences.
- Utility Locates: We call 811 (Underground Service Alert) before digging. You are responsible for marking private lines (e.g., landscape lighting, irrigation).
4. Safety and Property Protection
- Industry Compliance: All work follows ANSI Z133 arborist safety standards and Cal/OSHA regulations.
- Reasonable Care: We protect lawns, driveways, and structures using mats, plywood, and careful rigging. Minor lawn impressions or sawdust are normal and not considered damage.
- Pre-Existing Risks: We are not liable for damage to undisclosed underground systems, weak structures, or unstable trees.
5. Tree Removal & Stump Services
- Tree Ownership: You confirm legal authority to remove trees. We are not responsible for neighbor disputes, HOA violations, or city permits unless arranged in advance.
- Stump Grinding: Standard depth is 6–10 inches below grade. Full root removal or deeper grinding available at extra cost.
- Debris & Wood:
- All brush, branches, and logs are hauled away unless you request firewood (must be specified before work begins).
- Wood chips can be left on-site or removed (default: removed unless requested).
6. Cancellations and Rescheduling
- Free Cancellation: Allowed up to 24 hours before scheduled start time.
- Same-Day Cancellation / No-Show: $175 trip charge applies.
- Weather Policy: We may postpone for safety during high winds, lightning, heavy rain, or fire danger. No penalty to you.
7. Warranty and Limitations
- Workmanship Warranty: 30 days from completion. We correct defects in execution at no cost.
- No Survival Guarantee: We do not guarantee tree health after pruning, cabling, or transplanting.
- Acts of God: Not liable for tree failure due to storms, drought, disease, or root rot post-service.
8. Liability and Insurance
- Full Coverage: We carry $2M general liability and workers’ compensation. Certificates available upon request.
- Your Duty to Disclose: Inform us of bees, wasps, power lines, or unstable trees. Failure to disclose may limit coverage.
- Damage Claims: Must be reported within 48 hours of job completion.
9. Emergency Services
- 24/7 Availability: Storm damage and hazard trees prioritized.
- Premium Rates: After-hours, weekends, or high-risk jobs may include hazard or urgency fees.
- No Liability for Delays: During major storm events, response times may vary.
10. Dispute Resolution & Governing Law
- California Law Applies: All agreements governed by the laws of the State of California.
- Venue: Disputes resolved in Ventura County Superior Court.
- Good Faith: We attempt informal resolution before legal action.
11. Changes to Terms
We reserve the right to update these Terms. The latest version will be posted on our website. Continued use of services after changes implies acceptance.
